State Overview
Maryland’s Packaging and Paper Products – Producer Responsibility Plans Act (SB 901) was signed into law in May 2025. The program is administered by the Maryland Department of the Environment (MDE) and establishes a packaging EPR program requiring producers to fund the recycling system for covered materials. Funding includes reimbursing municipalities for the collection, transport, and processing costs of recycling and disposal of covered materials. The funding must cover 50% of costs by July 2028, 75% by July 2029, and 90% by July 2030.
Producer Compliance
Interchange 360 has submitted documentation to register and operate an Individual Producer Responsibility Plan (IPP) on behalf of petroleum and lubricant producers in accordance with the law and its supporting regulations. We are currently awaiting a response from the state with further guidance on next steps for Interchange 360 and producers in the industry. The statutory deadline for producers to register is July 1, 2026.
Producers that sell materials on Interchange 360’s Applicable Products List should register by the deadline. To register, obligated producers must sign a Participation Agreement and return it to memberservices@interchange360.com. A list of registered producers will be shared with MDE after the July 1, 2026, registration deadline.
Maryland Base Fees
There are currently no reporting requirements or program fees. Producers will be given advance notice in accordance with Interchange 360’s fee setting policy before reporting or fees go into effect.
