State Overview
Minnesota enacted the Packaging Waste and Cost Reduction Act in 2024. The Extended Producer Responsibility (EPR) program for packaging is overseen by the Minnesota Pollution Control Agency. The law includes requirements that by January 1, 2032, all packaging must be refillable and supported by such a system; reusable and managed through a reuse system; recyclable and collected through curbside or alternative program; or compostable and collected either curbside or through an alternative system.
Producer Compliance
The Minnesota law currently does not allow for independent compliance programs, such as Interchange 360’s, for hard-to-recycle materials. Instead, Interchange 360 established the Leaders Program in Minnesota, with operation planned to begin in early 2027. The Leaders Program is intended to show environmental leadership now, while helping build the data, infrastructure, and best practices needed for future EPR requirements.
Any brand-owners, retailers, or distributors of products on our Applicable Products List are eligible to join. Those interested should download and sign the Minnesota Participation Agreement and register in The Vault.
This program will provide a headstart for either when additional PROs are allowed under the current law in 2033 or if additional legislation is passed allowing for independent compliance programs beforehand.
Minnesota Base Fees
Interchange 360’s efforts in Minnesota are funded by producer fees. Each individual producer’s fees are based on the volume of covered materials it sells into the state versus the estimated costs of activities. Producers are responsible for paying back to the start date of planning fees regardless of their join date. To learn more about fees, visit our Producer Fees/Dues page.
